Two honest errors???: One that allowed me to order and then say they were out of stock/sold out (not truthful). The next time it was later accepting my order via an email stating it was entered, shipped, including tracking? Not a BAIT and SWITCH, just a BAIT and PULL THE PRICE, then later, BAIT AND CANCEL

Considering the speed with which they called after the sale was apparently put through, I suspect it never got to the point of being shipped. Probably it meant the sale was cancelled and money being refunded. Whenever a tracking number is issued, it does not necessarily mean the item has shipped.

And even if it was shipped, they could stop the delivery.

Order entry, shipping information and tracking numbers are all computer generated.

"Not a BAIT and SWITCH, just not a BAIT and PULL"

This is all about a typo that if you had been lucky enough to get away with, good for you! You weren't that lucky, so now you want to cry over spilled milk.

I've had that happen on a couple of occasions with non-photography equipment. At least I wasn't charged for what I didn't get. I know it's aggravating, but considering a large company is having a fire sale on a limited number of a certain product pretty much translates into well, we're out of this but we can sell you that. It's a very commonly used practice and is especially used a lot going into Black Friday just before Christmas....

I prefer to send my cameras and lenses to APS (Authorized Photo Service) out of Morton Grove, Illinois. The quality of their repairs is top notch, they are courteous, knowledgeable and the prices are very competitive. They only repair Nikon cameras and lenses and offer warranty repairs since they are an authorized repair station.

All of their technicians are trained by Nikon. I am not associated with them and I receive no endorsement from them, I am simply a very satisfied customer.
Although I have been using Nikon cameras and lenses for more than 50 years and the quality remains excellent we are not receiving the treatment loyal customers should.

I have seen practically everything from Nikon but what you have just mentioned I could not even imagine in my wildest dreams.

I, on the other hand have received EXCELLENT service on repairs from Nikonusa.com. I give them a call, I ask for repairs, I ask for a prepaid mailing sticker for my Nikon product, they email me one to put on my box so shipping is free. And I get updates from Nikonusa.com until my product has been serviced. GREAT, GREAT, GREAT.

I go to Walmart quite often in three states. I have never seen what you are describing in any of their stores. Have you contacted the manager to inform him of the mistakes? You tell us you see this, "Most every time I go to Wally World", yet you continue to go. It must not be that bothersome. Then you tell us they pay their overhead with the stolen money. If they are indeed doing this it is not totally legal at all. How do you come by this information that they pay their overhead this way? Are you an accountant, tax attorney, somebody large in the financial world?

Just amazing you have this damning information yet continue to shop at the store, probably have not contacted the manager even once and definitely have not contacted the police or the local district attorney.

This isn't really a bait and switch. The $1099 price was obviously a mistake. The law is not clear on what happens when dealing with a mistake, and every case gets decided on its own particular facts. I'm a lawyer, and I wouldn't take this case (or, actually, one involving at least ten times the mistaken price) on a contingent fee basis. I think a judge (assuming bench trial and not a jury) would award you something for your troubles, e.g., an hourly rate, but not specific performance of the contract you thought you had. Every lawyer has an opinion and this is just mine.

That doesn't make it "totally legal." It just removes the incentive to sue them. Some crusading customer might do just that, asking for exemplary (punitive) damages of a bazillion dollars. A big company would have significant exposure if there were a credible claim that it practiced deception, because way punitive damages are damages designed to hurt the company enough so that they won't do it again, and so that similar conduct doesn't appear with other sellers.

Nikon USA is at it again. I, for one am not surprised. If I was you, I'd file a complaint against them with your attorney general if he is any good in your state. You have the email showing they sold you the camera for the price; seems they are legally bound to me. I'm glad you brought this stunt to everyone's attention, it's the only way we have, as consumers, to stop this what I consider illegal activity. Only shows that Nikon still hasn't gotten the message. Maybe a boycott is in order!

A lot of these cases are settled out of court under sealed documents with no one admitting any guilt. That is, provided it goes that far....
