Another instance of questionable police action

This is video captured by a driver stopped at a drunk driving checkpoint:

Because his window was not down far enough he was subjected to further search and delay.

Yes, compared to other events, this one is minor. But, it is worth watching, and thinking about what you might do in a similar circumstance.

I was once stopped for some reason that seemed odd to me. However, as the strange actions by one policeman continued another cop car appeared and an apparently more senior policeman put a stop to the whole thing immediately, and sent me on my way.

Only watched the first 30 or so seconds but looked like to me the dumb-ass kid just wanted to start something so his video would go viral on youtube. Checked the youtube and it has over 3 million hits. Accomplished his goal. Good job.

I got as much of the story as I wanted - 21 year-olds can be punks, cops can be a**holes. A number of the youtube commenters thought the kid was being a jerk.

I think the kid was pushing a bit, but maybe to prove a point. The cops look like they were out to prove a point also. At no point was the kid disrespectful of the cops, though rolling his window down all the way would have avoided the whole thing. Even the cop that was searching the car knew the kid hasn't done anything wrong and said as much.

You should have watched the whole video.
Not a dumb ass kid.
The police were abusive and admitted to each other that "he knew his rights and was innocent" and they harassed him for that.

I ran into the same thing in Tucson AZ.

What is "crazier" than that is the fact that trained police are not allowed to search your car without probable cause, but some dog jumping on your car and giving a little scratch, gives the police probable cause. I love dogs, but they are not always known for their communication skills, trained or otherwise. I think my dog is hungry, but he has to go to the bathroom.

I watched the whole thing and whilst I agree that he was trying to provoke the officers, it does highlight the fact that the police should be aware of what they are and are not allowed to do.

This post is mistitled. There is no "questionable" police action here. The police were clearly in contempt of the mans rights. They KNOW they need probable cause. They KNEW they had none. They intimidated the man knowing his questions were reasonable and politely and non threateningly posed. They battered him for answers to their questions while refusing his simple and reasonable request to know if he were being detained. They damaged his cars finish with a dog no smarter than a trained ape. They illegally detained without informing that they were detaining. They took possession of the vehicle and searched it with no right to do so. They did everything but plant contraband in the vehicle which is certainly not beyond the realm of possibility for people such as these police officers, so willing to display contempt for the rights of the man they were so clearly detaining and holding in custody along with his property. Yes, this post is mis titled.

Cop was pissed and WRONG. Surprised he didn't use the " in plain view doctrine, claiming he saw an open can of beer, giving him probable cause. I had occasion to lecture Michigan State Police Sergaents class on this problem. I was appaled at the Attorney General's comments as to probable cause. both parties had a problem, the citizen had to stop, wait in line, questioned and delayed. The officer should understand his duty and rights in this No reason to think there was a drinking violation. Such as, bleary eyed, slurred speech and alcohol on his breath. Could not have unsteady on his feet. The young man could/ should have been understanding and cooperative. Who was wrong. Police

Yes and these are the goons that need to be rooted out, fired with complete loss of pensions, benefits,etc. A clear message and deterrent is all that will stop these over stepping brown shirts.
